LouisCard - Standard Terms and Conditions

If the LouisCard holder presents his/her LouisCard when purchasing goods in a Louis branch or enters his/her customer number when ordering from the online shop and is thus recognised by us as the holder of the LouisCard, we shall grant a 3-year guarantee on the goods purchased with this purchase. The only exceptions are batteries, shoes and boots. The guarantor is Detlev Louis Motorradvertriebs-GmbH, Rungedamm 35, 21035 Hamburg, Germany. The following rules apply to the guarantee:

• New products and their components which are defective due to manufacturing and/or material defects within 3 years of purchase shall be replaced or repaired by Louis at its own discretion with a new product of the same quality free of charge.
• This guarantee does not apply if the defect is due to improper handling, incorrect assembly of the product and/or failure to observe the operating instructions. The LouisCard user asserts his/her guarantee rights by either returning the affected product to a Louis branch or by sending it by post to Louis, Kundendienst, 21027 Hamburg, Germany. In order for us to pay the postage costs for a parcel, the LouisCard user can create a DHL return label under Returns.
• If repairs or an exchange is not possible for economic or other reasons, the LouisCard user shall be refunded the purchase price. The decision on the existence of economic or other reasons which make repair or exchange impossible is at the sole discretion of Louis. Louis has fulfilled its contractual obligation by refunding the purchase price.
• The guarantee period does not restart in the event of an exchange or repair. The statutory guarantee claims remain unaffected.
• The proof of purchase serves as proof of guarantee. The 3-year guarantee begins on the day that the invoice is issued and ends after 3 years. It is not transferable.
• Insofar as Louis exchanges goods or refunds the purchase price under the guarantee, it is already agreed today that ownership of the goods to be exchanged / credited shall pass reciprocally from the LouisCard user to Louis or vice versa at the point in time at which Louis receives the goods back from the LouisCard user and/or the latter receives the exchange delivery or refund of the purchase price from Louis..

Louis regularly organises competitions; to participate, you must be a LouisCard holder at the time of the prize draw and have used the card at least once for purchases in a Louis branch or in the online shop within the competition period.

The aim of the LouisCard is to offer the holder the greatest possible added value, i.e., benefit, over and above the services provided by our company. To this end, we also enter into co-operations with successful partner companies; our online shop provides detailed information about them and their services. Insofar as the granting of the benefits offered to the holder of the LouisCard by our partner companies makes it necessary for us to pass on the name and address of the LouisCard holder to our respective partner company, in accordance with our certifications, the LouisCard holder declares his/her consent to this, by his/her application for registration and issue of his/her LouisCard and/or its first use. However, this data may be used only by our partner company for the purpose of the respective benefits offered to the holder of the LouisCard and only in connection with the LouisCard; we shall oblige our partner companies accordingly. All services provided by LouisCard partner companies are voluntary services on our part which we have no legal claim over. If these services are subject to special conditions or restrictions, we shall inform the customer to the extent necessary.

If there is good cause, e.g. misuse of the LouisCard, we may demand that the holder of the LouisCard surrender it at any time. We are also entitled to block it.

We shall notify the holder of the LouisCard in writing of any changes or additions to these LouisCard Terms and Conditions. They shall be deemed to have been approved if the LouisCard holder does not raise an objection(s) or continues to use the LouisCard after being notified accordingly. The LouisCard holder must send his/her objection to us within one month of being notified of the change/addition; this shall also invalidate his/her LouisCard. We also reserve the right to discontinue or change all services associated with the LouisCard after we have notified the LouisCard holder.

When applying for the LouisCard, the applicant provides his/her consent for us to use his/her data for advertising purposes. The data remains with Louis and is neither sold nor leased. At any time, you may withdraw your consent to advertising being sent, without giving reasons. This is done via the individual advertising media or email to service@louis.de.

We store the data required for providing and billing all LouisCard services. All personal data shall of course be treated confidentially. We process personal customer data to implement the LouisCard customer programme. These are the voluntary personal notifications (Art. 6 Para. 1f GDPR), the contact data required for participation (data marked as mandatory fields*) and optional information in the LouisCard application (Art. 6 Para. 1a GDPR). The LouisCard holder has the right to object to the use of his/her data for the purposes of advertising or market and opinion research at any time without giving any reasons.
